Terms of Service

These Terms govern the use of MarcoFLY Framework ("MFF") — website marcofly.app, web app app.marcofly.app and related subdomains — provided by Marco Motta, also known as MarcoFLY Motta ("Owner"), Italy. By accessing or using MFF, you fully accept these Terms.

1. Service nature — Free public beta

MFF is offered as a free public beta: no paid features, no premium plans. The Service is experimental: it may change or be discontinued without notice. We do not guarantee SLA or specific uptime.

2. BYOK — Bring Your Own Key

To use the PWA's AI features, you must provide your personal API keys from supported providers. Keys are encrypted server-side AES-256-GCM, visible only to you, revocable by the provider.

⚠ AI provider cost disclaimer

You are solely responsible for all costs incurred with AI providers (OpenAI, Anthropic, Google, Groq, Perplexity, OpenRouter, Mistral, etc.) under their terms. MFF does not charge anything for AI usage — costs occur exclusively with the provider chosen by the user. MFF receives no commission or revenue share on these consumptions.

3. Voluntary donations (donationware)

MFF accepts voluntary donations via Polar.sh. Donations are completely optional, do not unlock features, and are not a purchase of goods. Managed by Polar.sh (Merchant of Record). Non-refundable except within Polar.sh policy (30 days for technical reasons).

4. Account and user responsibility

PWA access requires registration via Clerk. You are responsible for keeping credentials confidential, notifying unauthorized use promptly, providing accurate information at registration, not sharing API keys with third parties.

5. Acceptable use

You must not use MFF to generate illegal or defamatory content, attempt reverse engineering or mass scraping, circumvent rate limits or authentication, publish outputs violating AI providers' terms. The Owner may suspend the account at sole discretion.

6. Intellectual property

The MFF-EX framework (epistemic logic, labels, prompt templates) is protected by copyright © 2026 Marco Motta. Site source code is licensed under CC BY-NC-ND 4.0 (personal non-commercial use, no derivatives). AI-generated outputs belong to the user who generated them, subject to providers' terms.

Search engines and AI crawlers may freely read and index the entire site. However, training AI models (machine learning, text & data mining) on the MFF engineering prompt (currently v1.5.3), the epistemic labels and derivative models is expressly forbidden without written authorization from the author MarcoFLY Motta. This reservation constitutes an opt-out from text & data mining pursuant to art. 4 of EU Directive 2019/790 (TDM Reservation Protocol).

7. Limitation of liability

MFF is provided "AS IS". The Owner is not liable for damages from Service use, decisions based on AI outputs (epistemic labels are aids, not substitutes for human judgment), data loss or interruptions, unexpected charges on BYOK keys. Total liability is limited to any amount donated in the past 6 months.

8. Privacy and data processing

Personal data processing is governed by the Privacy Policy, integral part of these Terms.

9. Terms changes

The Owner may modify these Terms at any time. Substantial changes will be communicated via banner or email. Continued use implies acceptance.

10. Consumer rights

If you are a consumer in the European Union you are protected by the mandatory rules of Directive 2011/83/EU and EU Regulation 2018/302; if you reside in Italy, also by the Italian Consumer Code (D.Lgs. 206/2005). If you reside outside the EU, the mandatory consumer-protection rules of your country of residence remain unaffected, where applicable. Any unfair clause is void without affecting the rest of these Terms. You can delete your account at any time from Settings.

11. Governing law and jurisdiction

These Terms are governed by Italian law. For EU consumers, the competent court is that of the consumer's country of residence (EU Reg. 1215/2012; for Italy, art. 66-bis of the Consumer Code). The Service is accessible worldwide and we cannot guarantee prior compliance with the laws of every single country: where a mandatory local rule provides otherwise, that rule prevails; for everything else, use of the Service implies acceptance of these Terms as written.

Legal Basis
The work is protected by Italian Copyright Law (Law 633/1941), by Legislative Decree 518/1992 on the legal protection of software, and by the Italian Industrial Property Code (Legislative Decree 30/2005). The public license applied is Creative Commons BY-NC-ND 4.0 International: mandatory attribution, no commercial use, no derivative works.

Granted Rights — Personal Use
Users are permitted to view, consult and share the framework in its complete form for personal, educational and study purposes, on a non-commercial basis. Excerpts may be quoted for research, review or critical commentary, with mandatory explicit attribution in the form:

The attribution must be visible, legible and — where the medium permits — linked to the official site of the work.

Express Prohibitions
Without written authorization from the author, the following are strictly prohibited:
— using the work, in whole or in part, for commercial purposes, paid services, SaaS products, paid consulting, or remunerated training activities;
— creating derivative works, unauthorized translations, adaptations, reworkings, or modified versions;
— altering the meaning, decontextualizing passages, or presenting the framework in incomplete form in a way that induces distorted interpretations;
— removing or obscuring copyright notices, attributions, or legal references.

⚠️ Absolute Prohibition — AI Training
It is strictly forbidden to use the framework — in any form, total or partial, original or reworked — as training data for Artificial Intelligence systems or Large Language Models. The prohibition extends, without limitation, to:
— training of foundation models;
— fine-tuning, instruction-tuning, RLHF (Reinforcement Learning from Human Feedback) and equivalent methodologies;
— embedding, vector indexing and inclusion in retrieval datasets (RAG) intended for training;
— automated scraping aimed at any of the above uses.

This restriction operates under Article 4 of EU Directive 2019/790 on copyright in the Digital Single Market and constitutes an explicit opt-out from the text and data mining exception for commercial purposes.

For authorizations outside the scope of CC BY-NC-ND 4.0 — including commercial licenses, educational partnerships or institutional use — written authorization from the author is required.
